These territorial assumptions on the part of Massachusetts much increased the king's hostility. This probably would not have proved fatal had it not been re-enforced by the determination of the merchants and manufacturers of the mother-country to crush what they feared was becoming a rival power beyond seas. They insisted upon full enforcement of the Navigation Laws, which made America's foreign trade in a cruel degree subservient to English interest. So incorrigible was the colony, it was found that this end could be compassed only by the abrogation of the charter, so that English law might become immediately valid in Massachusetts, colonial laws to the contrary notwithstanding. Accordingly, in 1684, the charter was vacated and the colonists ceased to be free, their old government with its popular representation giving way to an arbitrary commission.

The foregoing comments apply to cargoes destined for Germany. Cargoes coming out of German forts present another problem under the terms of the declaration. Under the rules governing enemy exports only goods owned by enemy subjects in enemy bottoms are subject to seizure and condemnation. Yet by the declaration it is purposed to seize and take into port all goods of enemy "ownership and origin." The word "origin" is particularly significant. The origin of goods destined to neutral territory on neutral ships is not, and never has been, a ground for forfeiture, except in case a blockade is declared and maintained. What, then, would the seizure amount to in the present case except to delay the delivery of the goods? The declaration does not indicate what disposition would be made of such cargoes if owned by a neutral or if owned by an enemy subject. Would a different rule be applied according to ownership? If so, upon what principles of international law would it rest? And upon what rule, if no blockade is declared and maintained, could the cargo of a neutral ship sailing out of a German port be condemned? If it is not condemned, what other legal course is there but to release it?

 

From 1643 to 1684 Massachusetts, Plymouth, Connecticut, and New Haven formed a confederation under the style of the United Colonies of New England. Maine, Providence, and Rhode Island sought membership, but were refused as being civilly and religiously out of harmony with the colonies named. Connecticut, offensive to the Dutch, and exposed to hostilities from them, was the most earnest for the union, while at the same time the most conservative as to its form. It was a loose league, leaving each colony independent save as to war and peace, Indian affairs, alliances and boundaries. Questions pertaining to these were to be settled by a commission of two delegates from each of the four colonies, meeting yearly, voting man by man, six out of the eight votes being necessary to bind.
